Shooting in the presence of the landowner does not cover for the use of an illegally held gun.
Monday, 25 June 2007
My friend without a certificate leaves his shotgun in my cabinet. In winter he uses it to go game shooting. I'm not happy about this but he says it's okay because he's shooting in the presence of the landowner. Is this right?
Legal
DAVID FROST says: Emigrate to a country that has no extradition treaty with the UK. You are both breaking the law big time.
Firstly, your friend is heading for a jail sentence if he's found guilty of having a shotgun without a certificate.
Secondly, if you have somebody else's shotgun in your possession for more than 72 hours, you and the owner are both required to notify the police in writing. Failure to do so puts you in breach of the law.
Thirdly, in handing a shotgun over to somebody who you know not to have a certificate, or be exempt from the need to have one, you are committing a crime.
Finally, shooting in the presence of the landowner does not cover your friend for the use of his illegally held gun. This would only apply if your friend had borrowed the gun from the landowner or other occupier and was using it in his presence.
